Summary of Dispute

We bought a backhoe that was advertised as having AC and being meticulously maintained. Prior to buying we inspected it and found that the work that was advertised as being completed wasn't, as the mechanic was ill. I contacted James Jada and he agreed that there was work that hadn't been completed and gave us a $3K allowance off the purchase price to cover the cost of servicing all fluids and filters and additional repairs that hadn't been disclosed. It was advertised as "leak free", I sent him pictures of the leaks. Since we knew fluids hadn't been added, we turned on the AC to make sure it worked, but since Freon hadn't been added, we weren't expecting it to blow cold air. It turned out that their was no AC unit even installed, which James admitted, along with the lack of fluids and filters, among other items. We've already spent $3K fixing the obvious repairs, which he was made aware of, we're still missing a $5000 AC. This is a clear cut case of fraud and false advertising.

Summary of Transaction Venue's Actions

We're stuck with a backhoe that was advertised as having AC and it didn't. We live in Phoenix where it's 110 degrees, it's an enclosed cab and sitting inside it is unbearable. The seller James Jada said that the missing AC was "an oversight" when it reality it's fraud and false advertising. Additionally, I texted and talked to James prior to transferring funds and gave him a list of items that were either missing or never completed, contrary to the advertisement. The mechanic who was supposed to do the work had ended up in the hospital and none of the work that had been advertised had been completed. James gave us a $3K allowance to offset the work that would need to be done to bring it to it's advertised condition and his email 5-27 acknowledged those repairs and he agreed to pay our mechanic to fix them. We've gone past the $3K and that doesn't even include the $5K missing AC that was advertised as included.
